Part 1

COVID-19 & Contracts – Can I get out of my contract? A discussion on contractual rights and obligations that may be affected during the current crisis, and the extent to which COVID-19 may be invoked as a reason for non-performance of contractual obligations. This includes the immediate steps that companies should take to prepare for possible disruptions in contractual performance caused by COVID-19.

Attendee will learn the following:
1. Definition of Force Majeure and test for reliance on it
2. How to mitigate effects of Force Majeure event
3. What to do if your contract does not have a Force Majeure clause in it

Lisa Stiver is a partner at Thompson Dorfman Sweatman in its Business Law group. Her practice focuses on corporate and commercial law, with particular emphasis on commercial transactions, and on real property conveyancing, leasing and financing. As well, Lisa has significant experience in providing advice on contract drafting, interpretation and negotiation, as well as tendering and procurement in both the private and public sector.

Part 2

COVID & Privacy – Do privacy laws apply during a pandemic? A discussion on the key privacy law and confidentiality and security principles every business must consider when collecting, using, and disclosing personal information during a pandemic.

Attendee will learn the following:
1. Basic privacy law principles for the collection, use, and disclosure of customer and/or employee personal information
2. What to communicate to customers and/or employees when collecting personal information
3. Key confidentiality and security concerns especially when working remotely

Cathy Hamilton is a lawyer at Thompson Dorfman Sweatman and is a founding member of the firm’s Privacy and Data Protection Practice Group. Cathy provides advice to clients in the public, private and non-profit sectors on regulatory compliance with provincial, federal, and international privacy laws, risk minimization and management strategies, cross-border data flow issues, creation and implementation of privacy and data protection policies, procedures, and data breach prevention and response.
